Terms of Service

These terms of service apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and  Brilliant Tech Limited (“Fabryx”, “we”, “us”, “our”), trading as Fabryx, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

1. Availability: we endeavour to only advertise products that are readily available; however, we do not guarantee that our site or content will always be available, nor do we guarantee that we will provide an error free service. We may suspend our service for operational reasons such as repair, maintenance or improvements or otherwise in emergencies and we may change or discontinue the availability of any content, goods or services at any time as we see fit.

2. Method of payment: you can pay by credit card, debit card or PayPal. It is imperative that you provide the cardholder's name as it is shown on the card, and address exactly as it appears on the card. Card fraud is illegal and perpetrators will be prosecuted in all cases.

3. Out-of-stock: if any item you have chosen is unavailable, we aim to contact you via your e-mail address or via phone within 5 working days. You will then have the option to cancel the order or wait until the item is back in stock.

4. Warranty information: most items on the website have a manufacturer's warranty which is passed directly to the customer. Fabryx has no control over the terms of the warranty. If your product is faulty on delivery Fabryx will refund or exchange the purchase, subject to our returns policy.

5. Complaints: we aim to deal with all complaints as effectively as possible. Your complaint may be emailed to support@fabryx.co.uk or using the contact form on the website.

We aim to acknowledge by email any emailed or mailed complaint within 2 working days, and to conclude our investigations as soon as possible thereafter. Telephone complaints will not necessarily be acknowledged by email prior to investigation.

6. Courier/Royal Mail delivery disputes: please inform us as early as possible if your parcel is not received successfully from the courier so we can investigate (after allowing 3 working days since despatch notification). Courier companies are unable to investigate after 14 days of the alleged delivery date - so our deadline for investigations is also 14 days after alleged delivery date. Please email support@fabryx.co.uk and we will do our best to help with any courier issues.

7. Data protection & privacy: we will only use your personal data in accordance with goods and services requested from and provided from us. We will not share your personal details with any third parties.

We may need to contact to you via email or telephone in relation to an active order you have placed with us. We do not currently send any marketing emails or newsletters and would only do so if you have actively 'opted in' to receive them.

You have the right to request any personal that we hold about you by making a 'subject access request'.

8. Content: the design of our website including it's text, graphics, icons, content, structure, selection and arrangement are owned by Fabryx and all of our rights are reserved.

In addition, our site contains a significant amount of content, the copyright, trade marks and other rights to some of which are owned by their respective owners, who reserve all of their rights in respect thereof.

You must not and must not permit anyone else to either copy, download, store, modify, adapt, transmit, distribute, perform, play or show in public, broadcast, publish or otherwise use any part of the content on our website without our prior written agreement or that of the relevant owner of the content in question.

9. Price and availability: we reserve the right to change price and availability information without notice.

10. Warranties and liabilities: the information contained in the material in this website is only for information purposes. The material on this website does not constitute advice and you should not rely on any material in this website to make any decision or take any action.

Fabryx does not make any warranty or representation as to the accuracy or fitness for purpose of any material on this website. In no event do we accept liability of any description, including liability for negligence (except for personal injury or death),for any damages or losses (including, without limitation, loss of business, revenue, profits, or consequential loss) whatsoever resulting from use of or inability to use this website.

Exclusion of Fabryx’s liability: the use of our site is at your own risk. We shall not be liable to any person for any loss or damage that may arise from the use of any of the information contained in any content on our site.

Nothing in these terms and conditions of use shall exclude our liability for death or personal injury resulting from our negligence or any other liability that we are prohibited from excluding by law.

The content is provided on an "As is" basis. We shall not be liable for any loss or damage or for any costs, claims or demands of any nature whether arising out of tort (including negligence), contract or otherwise brought against you by any party arising directly or indirectly in connection with the use, inability to use, or performance of, our site and all other conditions, warranties and other terms, whether express or implied by law or otherwise to the contrary are hereby excluded to the maximum extent permitted by applicable law;

12. Other sites, advertisements and links: Fabryx excludes all liability for any illegality arising from or error, omission or inaccuracy in material created and submitted by third parties. This website also contains links to other websites which are not under the control of and are not maintained by Fabryx. Fabryx is not responsible for the content of websites that are referenced or linked on this website.

14. Law and jurisdiction: our site is created and controlled by Brilliant Tech Limited trading as Fabryx, a company incorporated under the laws of England and Wales. These rules shall be governed by, and construed in accordance with, english law, without giving effect to any principles of conflict of laws.
